Welcome to Jacta!

These Terms and Conditions ("Terms") govern your access to and use of our mobile application (the "App") on iOS and Android devices, as well as any related services provided by Jacta ("Company", "we", "us", or "our").

By downloading, installing, or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using the App, you confirm that:

  • You are at least 18 years old or have the legal authority to enter into this agreement.
  • You have read and understood these Terms.
  • If you are under 18, you may only use the App with the involvement and supervision of a parent or guardian.

2. User Accounts

To access certain features of the App, you may need to create an account. By creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your account credentials.
  • Notify us immediately of any unauthorized use of your account.
  • You are responsible for all activities that occur under your account.

Account Deletion & Data Removal
If you delete your account, all associated data will be permanently removed from our system and cannot be recovered.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations.
  • Attempt to gain unauthorized access to the App or its systems.
  • Use the App in a way that could harm its functionality or disrupt other users' experience.

4. Fees and Payments

Certain features or services within the App may require payment. If you choose to make a purchase:

  • Prices and payment terms will be disclosed at the time of purchase.
  • All payments are processed through the Apple App Store and Google Play Store and are subject to their terms.
  • Subscriptions automatically renew unless canceled before the next billing cycle.
  • All purchases are final and non-refundable.

5. Intellectual Property

The App and all content, features, and functionality are owned by Jacta or our licensors and are protected by intellectual property laws. You agree not to:

  • Copy, modify, distribute, sell, lease, or sublicense the App or any part of it.
  • Reverse-engineer, decompile, or attempt to extract the source code of the App.

6. User-Generated Content

If the App allows you to submit content (such as reviews, comments, or messages), you agree that:

  • You are solely responsible for any content you submit.
  • Jacta reserves the right to moderate, remove, or block content at its discretion.
  • Submitted content must not violate laws, include hate speech, or infringe on intellectual property rights.

7. Third-Party Services

The App may include links to third-party websites or services. We are not responsible for the content, policies, or practices of these third parties. Use of third-party services is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Jacta shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Loss of data, revenue, or profits resulting from your use of the App.
  • Your sole remedy for dissatisfaction with the App is to stop using it.

9. Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis without warranties of any kind. We do not guarantee that:

  • The App will be uninterrupted or error-free.
  • Any defects will be corrected.
  • The App is free from viruses or harmful components.

10. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion if you violate these Terms or engage in any unlawful or harmful activity.

11. App Updates & Changes

Jacta may provide updates, enhancements, or modifications to the App. By continuing to use the App after an update, you agree to:

  • Receive and install automatic updates, which may include bug fixes, new features, or changes to existing functionality.
  • Accept that some features may be modified, replaced, or removed at Jacta’s discretion without prior notice.
  • Ensure your device remains compatible with the updated version of the App.

12. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law principles. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of Canada.

13. End User License Agreement (EULA)

13.1 Acknowledgment

This End User License Agreement (“EULA”) is a legal agreement between you and Jacta governing your use of the App. This EULA is concluded solely between you and Jacta, not with Apple, Google, or any other platform provider. Jacta, not Apple or Google, is solely responsible for the App and its content.

Your use of the App must comply with the Apple Media Services Terms and Conditions (for iOS users) or the Google Play Terms of Service (for Android users).

13.2 Third-Party Beneficiary

You acknowledge and agree that Apple, Google, and their subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple and Google have the right to enforce this EULA against you.

13.3 Legal Compliance

By using the App, you represent and warrant that:

  • You are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country.
  • You are not on any U.S. Government list of prohibited or restricted parties.
